Anecdote (fam)In 1861. In fact the entire family appears in the 1861 census under the surname of Stewart - even David the father calls himself now David T Stewart. He was an inventor, and spent a lot of time selling his machinery in India where he eventually died when the steamer he was on, capsized in 1871. His patents were all registered in the name of David Stewart, or David T Stewart or David Turnbull Stewart.
His oldest two sons went to schoiol in Durham, enrolled as D H Stewart & J W Stewart, and they both went to India, however, they married there, and both decided to hyphenate their surname with 'Middleton', their mother Frances' maiden name, and became David Henry Middleton-Stewart and John William Middleton-Stewart.

AnecdoteDH M-S was my great great grandfather. Middleton-Stewart survives as the male surname from them. We know of all descendants (apparently) from those two, except JW M-S's oldest son David who came to Australia in the 1930s and seemed to vanish from the face of the earth after that.

What is intriguing is that sometime in the second half of the 1850s, David's family dropped Turnbull and adpoted Stewart as their surname. At the same time, David's brother George(1839), and sister Isabella(1849) added Stuart (different spelling) as their second names, as seen on their wedding& death certificates.

So something happened in the 1850s to bring about this change. I'll get to it in a moment. There also remains the younger brother John (b.1828ish-I do have the exact dates, but I'm just typing from memory here)

Family legend tells that for many generations, the oldest son was always to be called David and the second one always to be John. One of the Johns, (called Jack ) of whichever generation I do not know (perhaps this 1828 John, or perhaps his uncle born maybe around 1806?), apparently threw a man overboard a boat in a fit of rage, and fearing authorities and his life, he fled to somewhere. We guessed to USA, but have no idea really. He may have had a wife and young children, and would have been known as John Turnbull, at that time, not John Stewart, I think.

Family legend also says that our line is that of the eldest son of the Stewarts of Craigiehall in Scotland. The last recorded father of that line was a bit not right in the head, and after religious differences with his sons, disowned the three oldest, and apparently destroyed evidence of their ever having been his children. He sold the property, and build Newhalls nearby, and eventually the family lost that. The three sons with the 'religious differences' apparently went to Ireland, then to USA, and then back to UK, all in the early 1700s. I have not proof, just legend, and an occasional snippet from an old letter. Being Stewarts, they were supporters of Bonnie Prince Charlie, and as such were thence wanted by the English. Family legend has it that they might have changed their surname to the 'safer' border name of Turnbull, to escape persecution, in the mid 1700s. Perhaps, by 1850 when the coastt was clear, it was considered the duty of the eldest son to change back to Stewart again? We can only guess, but something made David (1826) change his family's name, and two of his siblings added Stewart as a second name all circa 1857, but remained as Turnbulls.

His birthplace could easily have been recorded wrongly.

Want of sureties indicates the offence was bailable, but no bail was forthcoming. I do not fully understand this as David appears to have been committed for a year, but I cannot find a record of his trial or crime.

That explains why David was not with his family in 1851, but by the 7 April 1861 Census he should have been out of custody, but again he is not with Charlotte and his daughters.

I think that he was either unwilling to return to them, or Charlotte had indicated he should not return. She had been taken in by relatives, and moreover was able to work to support herself and her daughters. She is described as “Bar Maid” in 1861.

David in 1861 is living in the same household as Emma Crockett, and giving his status as “unmarried”. This is a puzzle as the Crocketts appear to have been friends of David’s mother, Hannah Willoughby, as she was visiting them and her son, Thomas Willoughby, in 1851. They must have known David was married.

Charlotte Willoughby may have died in 1869. I think David and Emma went to Scotland to either marry bigamously, or to live as man and wife, their children were born there, and after Charlotte’s death they returned to Buckinghamshire as they are resident in Amersham in 1871. This theory could possibly be proved or disproved by the purchase of Civil Registration Certificates. There is no escaping the fact that David Willoughby gave a child from each of his families the second name of “Rimell”. This has to be uncommon enough not to be a coincidence and to indicate it is the same man.1
